By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below and agree to abide by and be bound by all decisions of the Sponsor which shall be final and binding, without right of appeal in all matters relating to this Contest.
Sponsor: Cineplex Entertainment LP (“Cineplex”) is the sponsor (“Sponsor”) of this Contest and Cineplex solely is responsible for conducting and administering this Contest, including the collection of all personal information.
1. How to Enter:
No purchase necessary. Contest begins at 4:00pm E.D.T. on Thursday, August 22, 2019 and ends at 11:59PM E.D.T. on August 25, 2019 (“Contest Period”). An Instagram account is required to enter this Contest. Before entering the Contest, ensure your Instagram wall is not set to private. To enter the Contest, Entrants must take and post a photo on Instagram from the photobooth activation at Fan Expo CANADA in Toronto, Ontario at the Metro Toronto Convention Centre and use the custom hashtag #FlashbackFilms2019
The hashtag must be used for the Entry to be valid. All photos must be posted no later than the end of the Contest Period. The Photobooths os available during normal operating hours and no ticket or payment is required to access the photobooth.
In order for your photo to be eligible, it must NOT:
· Infringe or violate the rights of any third party, including but not limited to, copyrights, trademarks, rights of publicity or privacy, moral rights, or any other intellectual property rights;
· Contain material that is inappropriate, indecent, contains profanity, nudity, sexual content, hateful content of any kind;
· Contain material that promotes violence or harm to another living creature or any other offensive content (as determined by Sponsor in its sole discretion) or content that could adversely affect the name, reputation, or goodwill of the Sponsor or Paramount Pictures Corporation (“Paramount”), its affiliates and its licensors and their respective properties;
· Contain material that promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing) or promotes any activities that may appear unsafe or dangerous;
· Contain the image of anyone under the age of majority in his/her province of residence without parental/guardian consent;
· Contain the image any other person without their permission. Sponsor reserves the right to require entrants to provide proof of written permission of others featured in the photo or video. Failure to provide written proof as requested by Sponsor will result in the disqualification of the entrant.
By submitting a photo, you represent and warrant that your photo is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by you to the full extent necessary to enable the Sponsor to use the photo as contemplated by these Contest Rules.
Each Entrant is limited to one (1) entry into the Contest. In the event the Sponsor discovers attempts at multiple entries by one person using the same or multiple Instagram accounts, each entry will be discarded, and the entrant disqualified at the sole discretion of Sponsor.
The odds of winning depend on the total number of eligible entries received during the Contest Period.
2. Prizes:
There are three prize packages to be won: - 1 year of free Flashback Films as part of the Flashback Film Series at Cineplex Theatres outlined here: https://www.cineplex.com/Events/Flashback (2 films per month for 12 months= 24 films)
- 1,000 SCENE points
The approximate retail value of both prizes combined are estimated $210. The Prizes do not include anything other than the prize elements unless set out above, including but not limited to transportation to and from the theatre, food, beverages and/or merchandise, or tickets to any other movies. Prizes are non-transferable, non-salable and cannot be converted to cash, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. No lost or stolen components of a Prize will be replaced. Sponsor or prize provider reserve the right to substitute any Prize for one of equal or greater value if the Prize should become unavailable for any reason. In the event that the winners are unable to redeem any or all of the Prize components, no compensation or substitute Prize will be provided.
3. Prize Drawing
Sponsor will conduct a random draw from all eligible entries on September 9, 2019 at approximately 10:00AM EDT in Toronto, Ontario to select three (3) potential winners of the Prize. The Sponsor will attempt to contact the potential Prize winners by private Instagram message, or by email for mail-in entries. If the selected entrants cannot be reached within one business day after the date of the draw or after 3 attempts to contact, whichever comes first, or if the potential winner refuse to accept the Prize, or if the prize notification is returned as undeliverable, Sponsor shall have the right to choose another entrant from the remaining eligible entries. Prior to receiving the Prize, each potential Prize winner must correctly answer, unaided, a mathematical skill testing question and sign a declaration and release form confirming understanding of, compliance with, and acceptance of the Contest rules and acceptance of the Prize as awarded and a standard release of all liability satisfactory to the Sponsor before being declared a Prize winner.
Sponsor must receive the declaration and release forms from the potential Prize winners within 5 business days from the date it is sent by the Sponsor or the potential winner will be disqualified and will not receive the Prize.
4. Eligibility:
Contest is open to individuals who are at Fan Expo CANADA, and are both legal residents of Canada (excluding Quebec) and at least fourteen (14) years of age at the time they enter the Contest (“Entrants”). Contest is not open to directors, officers or employees of the Sponsor, and any of its parent, subsidiary or affiliated companies, licensees, prize providers, promotion partners, advertising and promotional agencies (such entities, “Contest Parties”) or their immediate family (defined as parents, siblings, children and spouses, regardless of where they live), or those domiciled with directors, officers or employees of the Contest Parties. Sponsor reserves the right to verify the age of potential Prize winners and that such person is not ineligible to enter the Contest based on the foregoing sentence. Void where prohibited.
5. General Rules:
The Sponsor shall not be liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or illegible entries. By entering this Contest, entrants accept and agree to be bound by these rules and the decisions of the Sponsor, which are final, binding and conclusive on all matters relating to this Contest. All entries become the property of the Sponsor, none will be returned and no correspondence will be entered into except with selected entrants who will be notified by direct message to the Instagram account used to enter. The Sponsor reserves the right to disqualify any entrants who fail to follow these official rules and regulations or who make any misrepresentation relating to the Contest, drawing and redemption of any Prize, or who act with intent to annoy, abuse, threaten or harass any other person in connection with the Contest. This Contest is subject to all applicable Federal, Provincial and Municipal legislation. Entry constitutes permission to use the Prize winners’ name, photograph, and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law. Decisions of the Sponsor are final with respect to all aspects of this Contest.
The Sponsor shall not be responsible for any failure of the website, photobooth, Instagram platform, or any wireless network failure during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website or wireless network, or any combination thereof including any injury or damage to an entrant's or any other person's computer, mobile phone, mobile device, or property related to or resulting from playing or downloading any material in the promotion. Tthe Sponsor reserves the right, at its sole discretion, to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
In the event of a dispute, entries will be deemed to have been submitted by the Authorized Instagram account holder used at the time of entry. For the purpose of the Contest Rules: “Authorized Instagram account holder" of an Instagram account is defined as the natural person who is assigned to the Instagram account by Instagram. In the event of a dispute, selected entrants may be required to provide the Sponsor with proof that he/she is the authorized Instagram account holder associated with the winning entry. If the identity of an entrant is disputed, either the Authorized Instagram Account Holder associated with the Instagram account at the time of entry will be deemed to be the entrant.
Selected entrant may be required to provide proof that he/she is the authorized Instagram account holder .
The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).

6. Privacy: This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. However, you acknowledge that your use of Instagram to submit your photo is subject to Instagram’s Terms and Conditions and Privacy Policy. At Cineplex, we are committed to respecting your desire for privacy. Any personal information that we gather will be handled in strict accordance with our privacy policies and all applicable privacy legislation. Cineplex will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Cineplex as is disclosed herein and for the administration of the Contest and fulfillment of the Prize. Please note that by submitting personal information to Cineplex, you consent to our use as described herein http://www.cineplex.com/Global/PrivacyPolicy.aspx.
7. No Liability: Neither the Contest Parties nor Instagram, or any of the respective officers, directors, or employees (collectively, the “Released Parties”) shall be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, any prize awarded in this Contest or the events forming part of this Contest. By participating in the Contest or participating in or accepting any Prize, all entrants release, indemnify and hold harmless the Contest Parties from any and legal claims, demands, damages, action and/or causes of action, all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of any Prize or part thereof (including travel related thereto), and from liability to any other persons relating to or resulting from entering this Contest. None of the Released Parties make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of the Prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.
8. Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest or the Contest Rules or the rights and obligations as between the entrants and Sponsor in connection with the Contest shall be governed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws. All parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.
