OFFICIAL CONTEST RULES & REGULATIONS (“Contest Rules”)
THE FOLLOWING CONTEST IS VALID ONLY IN CANADA. TO BE ELIGIBLE TO ENTER THIS CONTEST ENTRANT MUST MEET THE REQUIREMENTS SET OUT IN SECTION 1 BELOW. THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. SUBMISSION OF AN ENTRY CONSTITUTES ACCEPTANCE OF ALL OF THE CONTEST RULES.
By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below.
Sponsor: The sole Sponsor of this Contest is Cineplex Entertainment LP (“Cineplex” or “Sponsor”).
NO PURCHASE NECESSARY. Contest commences 8:00AM CST on Wednesday, March 10, 2021 and ends at 11:59pm CST on Wednesday, March 31, 2021 (“Contest Period”).
1. ELIGIBILITY
Contest is open to individuals who are legal residents of Saskatchewan, Canada who are over the age of 18 at the time of entry. Contest is not open to employees and those domiciled with employees of Sponsor or its parent, subsidiary or affiliated companies, licensees or advertising and promotional agencies. Sponsor reserves the right to verify eligibility of a potential prize winner including but not limited to verifying that the potential prize winners are not an employee (or domiciled with employees) of Sponsor or its parent, subsidiary or affiliated companies, licensees or advertising and promotional agencies, and without verification to the sole satisfaction of Sponsor, to deny entry to that entrant. Void where prohibited.
2. HOW TO ENTER
NO PURCHASE NECESSARY. Before entering the Contest, ensure post setting is set to “Public” prior to submitting your post on your Facebook or Instagram account. To enter the Contest on Facebook, you must: (i) Tell us which 3 friends you would invite to a Private Movie Event at Cineplex. To enter the Contest on Instagram, you must: (i) Tag 3 friends in the original post comments section, (ii) re-post in your Instagram Story, (iii) Tag @CineplexMovies in your Instagram. One (1) extra entry will be given if you re-post on your Instagram account.
Posts must be submitted no later than the end of the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with the selected potential Prize winners. Posts that are deleted by Facebook or Instagram for any reason, including but not limited to violation of the Facebook or Instagram terms and conditions, will be invalid and the entrant will be disqualified.
Entries received shall be deemed to be submitted by the person in whose name the identified Facebook account was registered. For the purpose of the Contest Rules, “authorized account holder" of an Facebook or Instagram account is defined as the natural person who is assigned to the Facebook or Instagram account by Facebook, Instagram and/or an on-line service provider. The potential Prize winners may be required to provide the Sponsor with proof that they are the authorized Facebook or Instagram account holder associated with a winning entry.
Each entrant is permitted to enter once via each of the entry mechanisms set out above, for a maximum of three (3) entries overall. Each entrants is only permitted to win one Prize. The odds of winning will depend on the total number of eligible entries received during the Contest Period.
3. THE PRIZE
There are two (2) prizes (each a “Prize”, collectively, “Prizes”) available to be won. One (1) in Regina and one (1) in Saskatoon.
Each Prize consists of the following: One (1) Private Movie Night (CDN $200.00) at either a Cineplex theatre located in either Regina or Saskatoon. Prizes must be accepted as awarded without substitution and are not transferable or redeemable for cash or allowed to be sold (including the sale of individual tickets to the screening), and no warranties or guarantees regarding any Prize is expressed or implied. The Sponsor reserves the right to substitute the Prizes in whole or in part in the event that all or any of the components of the Prizes are unavailable. In the event that a winner is unable to redeem any or all of the Prize components due to reasons beyond the control of the Sponsor, its employees, representatives, and agents, no compensation or substitute Prize will be provided. Max 20 guests per prize.
One private screening will take place in a Cineplex Theatre in each of Regina and Saskatoon. Exact theatre location to be determined by Sponsor. Private screening must take place during the theatre’s regular business hours. Film selected must be playing in regular release at the selected theatre on the date of the screening. Screening must take place by April 30, 2021. Time extensions will not be granted except as set out below. Additional restrictions may apply. The private screening does not include anything other than the Prize components set out above. Winner and guests are responsible for paying for any other concession, food and beverage items (including alcohol) they may wish to purchase at the theatre. Cineplex will work with the winner to select a date, time and location for the private screening that is mutually agreeable; however, the final decision will be at Cineplex’s sole discretion if a mutual agreement cannot be reached. Once booked, the date, time and/or location of the private screening cannot be changed. If the private screening is cancelled by the winner for any reason, the winner will forfeit the Prize without additional compensation. The winner and all guests must be of age to see the film based on the provincial film classification guidelines. At least one person in attendance must be over the age of 18. Cineplex reserves the right to verify the age of the winner and guests and has the right to deny any patron access to the theatre that does not meet the age limit. Winner and his/her guests are solely responsible for transportation to and from the theatre. Notwithstanding the foregoing, Number of invited guests may not exceed the public gathering limits set by the Province or municipality where the screening will take place, which is subject to change. Sponsor shall not be responsible if the number of permitted guests must be reduced as required by laws or acts of government, and no alternate Prize component or cash equivalent will be provided by Sponsor. However, if public gathering are prohibited, or if Cineplex is required to cancel the screening as required by laws or acts of government, Cineplex, in its sole discretion, shall either extend the deadline to book the screening, or issue the winner(s) an alternate prize of equal or greater value. Winner and all guests must comply with public safety or other guidelines as reasonably required by Sponsor, including wearing of masks, social distancing, and sitting in designated seats within the auditorium to ensure social distancing while watching the movie. Failure to do so will result in the group being asked to leave the theatre.
4. CONTEST DRAW
Sponsor will select in a random drawing in Edmonton, Alberta on or about 1:00 pm CST, on April 1, 2021, the potential Prize winners. The Sponsor will attempt to contact the potential Prize winners by direct message with instructions on how to contact Sponsor to complete the Prize verification process. Potential Prize winners will have three (3) business days to contact the Sponsor. In the event that a potential Prize winner does not contact Sponsor within the specified period of time, they will be disqualified and another entrant may be selected from the remaining eligible entrants. This process shall continue until the potential Prize winners are selected. Potential Prize winners must correctly answer a mathematical skill-testing question to be administered by phone or in writing and sign a declaration and release form: (a) discharging and releasing the Sponsor and its partners, parent, subsidiary or affiliated companies, officers, directors, shareholders, or employees from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or non-use of the Prize; (b) confirming compliance with the Contest Rules; (c) consenting to the publication and/or use, in any medium of your name, and city of residence for publicity purposes carried out by the Sponsor for without payment or compensation of any kind; and (f) accepting the Prize, as awarded (a “Declaration and Release Form”).
5. GENERAL RULES
The Sponsor shall not be liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or garbled entries. By entering this Contest, entrants accept and agree to be bound by these Contest Rules and the decisions of the Sponsor, which are final, binding and conclusive on all matters relating to this Contest. The Sponsor reserves the right to disqualify all entrants who fail to follow these Contest Rules or who make any misrepresentation relating to the Contest, drawing and redemption of the Prizes. This Contest is subject to all applicable federal, provincial and municipal legislation. Entry constitutes permission to use the winner’s name, photograph and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law.
6. PRIVACY
This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Any personal information that is collected by the Sponsor will be handled in strict accordance with the Cineplex Privacy Policy, available at http://cineplex.com/Global/PrivacyPolicy and all applicable privacy legislation. Sponsor will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Sponsor as is disclosed herein. Please note that by submitting personal information to enter this Contest, you consent to Sponsor’s use of your personal information in order to manage and administer this Contest.
7. TECHNICAL DIFFICULTIES AND TAMPERING
The Sponsor shall not be responsible for any failure of any website or social media site during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, or failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the Contest. The Sponsor reserves the right, at its sole discretion to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Sponsor is also not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Contest Rules, the selection and announcement of winner, or the distribution of the Prize.
8. NO LIABILITY
Neither Sponsor nor Facebook/Instagram, and each of their respective officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, sponsors, successors and assigns (i) make any warranty, guaranty or representation of any kind concerning any Prize, (ii) disclaim any implied warranty, and (iii) are not liable for injury, loss or damage of any kind resulting from acceptance, use or misuse of the Prize, or from participating in this Contest.
9. SPONSOR HAS FINAL SAY
Decisions of the Sponsor are final and binding with respect to all aspects of this Contest.
10. CLOSE OF CONTEST
The Contest closes at 11:59pm CST on Wednesday, March 31, 2021. However, the right is reserved by the Sponsor to withdraw, terminate or modify this Contest at any time without prior notice.
In the event that it is not possible to award another entry due to discontinuance of the Contest for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the Prizes offered herein.
